Hi

Just a small not to let you know how the claim is progressing.
The insurance claim against Arun Cars has been hampered because the sales manager gave my insures the wrong details for their insurance company!! Its rather annoying because at the moment I am out of pocket over one thousand pounds.

The insurance company did not let me know about this until I rang to ask how the claim was progressing.

It would have been nice to get it back before Christmas but no hope there.
The car is driving lovely but I have not yet decided to keep it or sell it.

After a long think and much consternation I have decided to sell the XKR

I have decided that I will use the money to finish my MK2 Daimler.

I think this will help to draw a line under it all and put another classic back on the road.

Insurance has not yet been sorted regarding the claim so no news there.

sorry to see you are selling the XKR. I have followed this thread and feel sad to see that someone has tainted your view of the car. I am sure you will sell the car easily to a fellow enthusiast.
On the other hand another classic will be finished and put back on the road.
I wish you luck with both your decisions.

Thanks for your post, the whole thing has spoilt it for me but the money will
be used on another classic, and maybe, I will get another XK in the near future.

I hope whoever buys it enjoys it as much as I did, theyt will be getting a great car.
It is on ebay at the moment.

I have sadly now sold the XKR to a very nice man from Wales, hopefully he will join JEC
and show the car.
The insurance has still not been sorted, this is now dragging on a bit to long.

Also something of interest about the legal cover, I put in a claim for my uninsured loses, ie excess, transport costs, and other out of pocket expenses which the legal insurance is supposed to cover, my car was damaged by a third party, they have admitted being at fault, but the legal protection cover, Albany, say they will NOT claim back my losses for me as I have not had a road traffic accident !! I cannot see where it says you have to be in an accident, just that they will get your losses back for you.
I have a letter from Albany Assistance dated the 8th of September which in the second paragraph states, We administer uninsured loses recovery claims on behalf of Footman James, which means that we will assist you in the recovery of any financial losses and expenses incurred in the incident, from the responsible party, or their insures. !!!
Well they won't !!!
I have spoken to Footman James about this but have not had any luck so far, has anyone else had this problem because as I see it they are in breach of contract.

A word perhaps, Vince with The Insurance Ombudsman?

Sounds as if they are trying to rewrite their rules after an event has occurred for which they hadn`t catered or perceived as a likely event.

Yes I could look at going to the ombudsman, I would like to give Footman James a bit longer to sort this with Albany but if I have no luck then yes, I will.

Just send Arun a summons from the small claims court for the difference which you cannot get back from the insurers. The cost is well worth it and also recoverable. They were the ones who started this whole sorry affair. Stick to your guns, you are in the right.

I have just got a letter from Albany Assistance LTD, they are refusing to act on my behalf and claim my uninsured losses for me !!
The state that because I have not had a road traffic ACCIDENT they will not act on my behalf, they say it is a breach of contract between me and the garage Arun Cars!!

So be warned, if you have legal expenses cover it only covers you if you have had a road traffic accident and it is not your fault, this does bring up the point that whats the point having legal cover !! if you have a non fault accident you can claim your out of pocket expenses anyway.

And so the saga continues.

A court sanctified claim will bring their minds back into focus pretty damn quick !

I have still not managed to get all of my out of pocket expenses yet!
I have had a partial payment of a few hundred pounds with a few more to come.

I drove past Arun Cars a few weeks ago and guess what, the person who tried to de-fraud me was in the fourcourt at Arun Cars !!
Looks like that they do give give a s--t about their customers and where probably all in on it.
People like those at Arun do not deserve to be in the trade at all.
But let me tell you this, WHAT GOES AROUND COMES AROUND.

I have just received the final settlement of my claim against Arun Cars 14 months after I made the claim!! I have to say that Footman James did not do very well with this and I am very disappointed with the whole thing.
The legal expenses claim was a complete sham and I do think paying for legal cover is a waste of money, you can only use legal cover if your accident is not your fault in which case you do not need legal cover.
The next thing is, do I now get another Jag ??
