Accelerating when cold

Evening all,
Trying to help my friend diagnose this problem.
He has a ‘04 X350 XJ. When cold the car ‘feels’ as though it’s fighting against the brakes/ accelerating itself. Once heated brakes are perfect Nd it accelerates normally.
Could this be an issue with Throttle body? Or TPS?

If so is it normal for this to happen only when cold?

Or could be that the issue is solely with brakes when cold?

Engine Management light is illuminated.

I assume you mean an 04 X350 XJ, not an X308 XJ?

How many miles has it done and when was the gearbox fluid and filter last changed? The surge and jerky feeling when cold can be a symptom of gearbox and torque converter needing some nice new fluid!
